HONOURABLE SRI JUSTICE N. BALAYOGI CIVIL MISCELLANEOUS APPEAL No.1571 of 2008 JUDGEMENT:

As per the docket-proceeding sheet order dated:10-4-2018 that in spite of direction to the appellant vide order dated:27-3-2018 directing the appellant to secure correct address of the respondents and serve notice and when posted the matter after one week, none appeared for appellant. The correct address of the respondent/s was not filed and further proof of service was also not filed. In such circumstances, the Court compelled to post the matter under the caption of "For Dismissal".

Today, in spite of posting the matter under the caption of "For Dismissal", none appeared for the appellant and there is no representation which clearly make out that the appellant is not acting diligently and has no interest to prosecute the matter. 3.

In the result, this Civil Miscellaneous Appeal is dismissed for non-prosecution with costs.
