This petition is filed under Section 24 of C.P.C. seeking to withdraw F.C.O.P.No.67 of 2016 from the file of the Family Court, Kurnool, and transfer the same to the file of the Court of the Senior Civil Judge, Eluru.

At the time of arguments, learned counsel for both parties submitted that during pendency of the transfer petition, the respondent died. They further submitted that the purpose of filing the transfer petition has become infructuous, in view of death of the respondent.

Recording the submission made by the learned counsel for both parties, the Transfer Civil Miscellaneous Petition is dismissed as infructuous. There shall be no order as to costs.
