HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION Nos.15605, 17159 and 18522 of 2015 COMMON ORDER:

These Writ Petitions are filed consequent to return of the applications filed, under Section 6-C of the Essential Commodities Act, 1955, in the appeals pending before the Principal District and Sessions Judge, Warangal, seeking suspension of the orders passed by the District Collector, Warangal in 6-A proceedings initiated against the petitioners.

The applications were returned by the office with an endorsement to show the reasons as to the maintainability. Though the present Writ Petitions are filed against the said endorsement made by the learned Principal District and Sessions Judge, Warangal, learned counsel for the petitioners expressed his willingness to submit bank guarantee for the goods ordered to be confiscated by the District Collector, Warangal since the petitioners apprehend that the goods are going to be sold pursuant to the orders of the District Collector.

In the circumstances, without driving the petitioners to file applications in pending appeals before the Principal District and Sessions Judge, Warangal, for release of stock, the Writ Petitions are disposed of directing respondent Nos.2 to 4 not to sell the stock, covered by the order of the District Collector, Warangal, pending disposal of the appeals before the Principal District and Sessions Judge, Warangal, and release the same to the petitioners on their furnishing bank guarantee to the value of the confiscated stock to the satisfaction of the District Collector, Warangal, within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petitions are, accordingly, disposed of.

As a sequel thereto, miscellaneous applications, if any, also stand disposed of. No order as to costs.
