HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28480 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the second respondent in considering the petitioners' representation dated 17.06.2016 as illegal and arbitrary.

2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Agriculture (Andhra Pradesh) representing the respondents 1 to 4.

3. A perusal of the record reveals that the petitioners have been carrying on vegetable business in Rythu Bazar, MVP Colony, Visakhapatnam.

It is the case of the petitioners that the respondents are demanding more amount towards rent. The petitioners herein have submitted a representation to the second respondent on 17.06.2016. For one reason or other, the second respondent has not disposed of the representation of the petitioners.

4. At the time of arguments, the only relief sought by the learned counsel for the petitioners is to direct the second respondent to dispose of the representation of the petitioners dated 17.06.2016 as expeditiously as possible. The learned Assistant Government Pleader also consented for the same.

5. In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case.

6. Having regard to the facts and circumstances of the case

and also the submissions made by both the counsel, the second respondent is hereby directed to dispose of the representation of the petitioners dated 17.06.2016 in accordance with law within a period of two months from the date of receipt of copy of this order.

7. With the above direction, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
