THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.23071 OF 2016 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

2. The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the 3rd respondent in calling and threatening the petitioner to come to the police station as most unwarranted, illegal and consequently, to direct the 3rd respondent not to interfere with the petitioner's land to an extent of Ac.0.10 Gts., in Sy.No.763/A situated at Boddugudem Village, Mothkur Mandal, Nalgonda District.

3. The grievance of the petitioner appears to be that the 3rd respondent is illegally and intentionally calling the petitioner to the police station and threatening him to implicate in a false criminal case if he does not settle the land dispute pending between him and one Pailla Pushpalatha W/o. P.Somi Reddy.

4. Learned Government Pleader for Home submits that allegations made in the writ petition are all false and the 3rd respondent will not summon the petitioner to the police station and not interfere with the petitioner's land, except in accordance with law.

5. Having regard to the above, the Writ Petition is disposed of

directing the 3rd respondent-police to be mindful of the limits of their jurisdiction in criminal law and not to interfere with any civil dispute pending between the petitioner and one Pailla Pushpalatha W/o. P.Somi Reddy. Needless to mention that the 3rd respondentpolice shall follow due process of law while summoning the petitioner to the police station or arresting him in the event of a crime being registered against him.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
