ORDER :

Petitioner claims that he purchased the land in Sy.No.1123/1A to an extent of Ac.2.30 cents and in Sy.No.1123/1B to an extent of Ac.1.28 cents of Basinikonda village, Madanapalle Mandal, Chittoor district in the public auction conducted by the Chittoor District Cooperative Central Bank Limited, Chittoor. According to petitioner, once property is purchased in an open auction earlier status of land, even it is described as assigned land looses the same and there shall not be any prohibition or alienation of said land and in support of said contention, learned counsel for petitioner placed reliance on the decision of this Court in W.P.No.6758 of 2009, dated 01.04.2009. However, petitioner is now aggrieved by inclusion of said property in the list of prohibited properties. On 08.03.

2018, petitioner made representation to the District Collector, Chittoor District informing him that subject property was purchased in an open auction conducted by the Chittoor District Cooperative Central Bank Limited and, therefore, it cannot be included in the list of prohibited properties. Alleging inaction on the said representation and not permitting to alienate the subject property, this writ petition is filed. 2.

Since petitioner has already submitted representation to the District Collector, Court is not inclined to keep the writ petition pending. Writ petition is accordingly disposed of, directing the District Collector to examine the claim of petitioner as ventilated in the representation dated 08.03.2018 to delete the properties from the list of prohibited properties and to pass appropriate orders as warranted by law as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order. Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
