THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1852 OF 2016 ORDER:

This Criminal Revision Case is filed by the petitioners-A14 and A15 challenging the order dated 17.12.2015 passed in C.C.No.240 of 2012 by the X Metropolitan Magistrate, Cyberabad at Malkajgiri, Ranga Reddy District.

In spite of the directions given by the Court below, the petitioners did not appear before the Court below. Therefore, the Court below issued NBWs against the petitioners and other accused. Aggrieved by the same, the petitioners-A14 and A15 filed this revision. Heard and perused the material available on record. It is the case of the petitioners that as they were compelled to attend the religious ceremony, they did not appear before the Court below and their absence is not wilful.

Considering the facts and circumstances of the case, the petitioners-A14 and A15 are directed to surrender before the Court below and move an application seeking to recall NBWs issued against them. On such surrender and on such application being filed, the Court below is directed to recall NBWs issued against the petitioners and release them on the same day on condition of each of them executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Court below. The petitioners are directed to appear before the Court below on all hearing dates.

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
