HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 11626 of 2016 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Home.
The grievance of the petitioner appears to be that respondent Nos.2 and 3 are harassing the petitioner in relation to investigation in Crime No.681 of 2015 of P.M.Palem Police Station, registered for the offences punishable under Sections 447, 427 and 506 read with 34 IPC and Sections 3 and 4 of the Andhra Pradesh Land Grabbing Act.
A counter came to be filed by the respondents denying the said allegation. It is stated that the respondents-police have tried to serve notice under Section 161 Cr.P.C. but the petitioner instead of co-operating with the investigating agency filed the present writ petition by making false and baseless allegations. It is also stated that the allegation of respondents interfering or harassing the petitioner is false and baseless. Having regard to the allegation and counter allegations made and in the absence of any independent evidence to prove the same, it would be difficult for this Court to adjudicate the issue. However, having regard to the facts and circumstances of the case, there shall be a direction to the respondent authorities not to interfere with the life and liberty of the petitioner or subject him to any detention except in accordance with law. With the above direction, the Writ Petition is disposed of.
No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
