THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20639 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to issue an appropriate writ, order or direction more in the nature of Mandamus, declaring the action of the 2nd respondent in directing the petitioners to settle the disputes with the respondents 3 to 12 herein by taking into the cause which is of civil in nature without there being any authority or jurisdiction that too when the matter is ceased up by the competent Civil Court apart from the respondents 3 to 12 were suffering an order of injunction and making the petitioners to sit hours together without there being any crime registered against them as being illegal, arbitrary and is in negation of established judicial precedents apart from being in violation of Article of the Constitution of India, and consequently direct the 2nd respondent not to interfere in the civil disputes between the petitioners and the respondents 3 to 12 herein and not to harass the petitioners and pass..."

2. Heard the learned counsel for the petitioners and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 and 2. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not adjudicating the case on merits, it may not be necessary to hear respondents 3 to 12.

3. The grievance of the petitioners is that respondent No.2 is interfering with the civil dispute between the petitioners and respondents 3 to 12, which is subject matter of Original Suit No.117 of 2016 on the file of the Junior Civil Judge, Kodad, Nalgonda District, and pressurizing them to withdraw the suit filed by them by calling them to police station and making them sit hours together. Learned Assistant Government Pleader, on instructions, states that respondent no.2 is not interfering in civil disputes and any action taken would be in accordance with law.

4. Recording the said statement, the Writ Petition is disposed of making it clear that any action taken by the police shall be in accordance with law. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order.
