THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35099 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 2 and 3 in interfering with the civil disputes between the petitioner and the fourth respondent with regard to the property in an extent of Acs.0.87 cents in survey No.143/1 of Chinnagadili Revenue Village, Visakhapatnam Rural and Acs.55.00 cents in survey Nos.59/1, 60/1, 62/1, 62/2, 64/2, 65/1, 65/2, 66/1, 69/1, 70/1 and 71/2 situated in Rompelli Village, Anantagiri Mandal, Visakhapatnam District as illegal and arbitrary, and also consequently direct the respondents 2 and 3 to provide police protection to the petitioner from the threats of the fourth respondent. Heard and perused the material.

Learned counsel for the petitioner submits that the respondents 2 and 3 are interfering with the civil dispute between the petitioner and the fourth respondent and they are harassing the petitioner by calling him to the police station.

Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the respondents 2 and 3 are not interfering with the civil dispute between the petitioner and the fourth respondent. Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the respondents 2 and 3 not to interfere with the civil dispute between the petitioner and the fourth respondent and they are further directed to follow the due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 19.10.2016 pln
