Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Aggrieved by the order of Tahsildar, Burgampahad Mandal, Bhadradri Kothagudem District, holding that the petitioner is an illegal purchaser of assigned land and the same was in violation of the provisions of A.P.Assigned Lands (Prohibition of Transfers) Act, 1977, ordered for resumption of land. Aggrieved thereby, petitioner preferred appeal before the Revenue Divisional Officer, Bhadrachalam-3rd respondent, who assigned Appeal No.LTR/5/BPD of 2018. Along with the said appeal, petitioner also filed application for grant of stay. Alleging inaction on the application to grant stay and threat of dispossession, this writ petition is filed.

Since appeal is already filed with application for grant of stay, the Court is not recording detailed reasons. It is suffice to note from reading of the order of Tahsildar that purchase was made from the assignee in the year 1996 and from him petitioner purchased and the revenue records itself would disclose that from the year 2002-03, name of the petitioner is reflected in the revenue records. Tahsildar also holds that petitioner belongs to below poverty line category.

Having regard to these facts, pending consideration of the application for stay, respondents are directed not to dispossess the petitioner from the land admeasuring Ac.2.14 guntas in

Sy.No.440/56, Burgampahad Village, Bhadradri Kothagudem District. The 3rd respondent is directed to dispose of the application for grant of stay, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of copy of this order.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
