Heard the learned counsel for the petitioner and the learned Government Pleader for Excise.

The petitioner herein claims to be the owner of vehicle bearing registration No.AP-03-TC-8422, which is stated to have been seized in view of registration of FIR No.16 of 2015, dated 10-03-2015 by the 3rd respondent. The petitioner states that he is no way connected to the said crime and as the owner of the vehicle, no liability is cast on him. He therefore approached the 2nd respondent on 19-03-2015 seeking interim release of the vehicle in question. Alleging that no action is taken on the said application till date, the present writ petition is filed.

Learned Government Pleader, who has received instructions, states that the application of the petitioner with regard to interim release of the vehicle was received by the 2nd respondent through petitioner's counsel and the 2nd respondent has already issued a memo to the 3rd respondent on 31-03-2015 directing him to obtain valuation report of the vehicle in question from the concerned Motor Vehicle Inspector and the said report is awaited. In view of the fact that the petitioner's vehicle was seized almost three months back and his application for release is pending for over one and half month, I deem it appropriate to dispose of the writ petition by directing the 2nd respondent to take all necessary steps and consider and dispose of the petitioner's aforesaid application within ten days from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
