HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.8997 OF 2003 ORDER:

The petitioner complains against inaction in preventing collection of services charges as prohibited vide G.O.Ms. No.287, Food and Agriculture (Mktg.1) Department, dated 29.04.1989 read with Memo dated 24.04.2003.

The writ petition was admitted in the year 2003 and is listed for final hearing after several years.

As the prayer is one against the inaction, having regard to the fact that so much time is lost during the pendency of the writ petition, this Court does not consider the inaction complained in the writ petition at this stage of the matter. The collection or otherwise of service charges if are contrary to either Government orders or Memos issued from time to time, it is open to the petitioner to bring the same to the notice of 2nd and 3rd respondents by enclosing a copy of this order and the respondents are directed to consider such representation and pass appropriate orders.

The writ petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
