HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition Nos.18224 & 20753 of 2008 COMMON ORDER: (per Hon'ble Sri Justice V. Ramasubramanian) Aggrieved over the construction of a Toll Plaza at KM 33 on NH-7, Hyderabad-Kurnool road, the petitioners came up with the above writ petitions by way of Public Interest Litigation (PIL).
2. During the pendency of the writ petitions, the National Highways Authority of India (NHAI) located the Toll Plaza at KM 54/0 of Hyderabad - Bangalore section. But it was stated in the counteraffidavit that the said location was for the time being. However, today Sri Srinivasa Rao Sagi, learned standing counsel for the NHAI, produced a copy of the communication dated 04.06.2016 sent by the NHAI to the following effect:
"In connection with the above W.P., it is to inform that the proposal for constructing the permanent Toll Plaza @ Km.54/0 of Hyderabad-Bangalore section of NH-44 i.e. location of temporary toll plaza, is approved by the competent authority of NHAI.
The same may be conveyed to Hon'ble High Court of Andhra Pradesh with a request to dispose the related WP No.20753/2008, please."
3. In view of the above, the grievance of the writ petitioners stands redressed. Hence, no orders are necessary in the above writ petitions. Accordingly, both the writ petitions are closed. There is no order as to costs. Pending miscellaneous applications if any, in these writ petitions shall stand closed.
