Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased issue a writ, order or direction more particularly one in the nature of writ of Mandamus holding the action of the respondents 1 to 4 in continuing respondents 5 and 6 in service though they were convicted in S.C. No 187/1991 dated 1-06-2009 on the file of Assistant Session Judge, Proddatur is illegal, discriminatory and against to Rule 8 (2) (b) and Rule 25 (i) of A.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of SRI D. KODANDARAMI REDDY Advocate for the Petitioners, and of the Govt. Pleader for Home for respondents 1 to 4, the Court made the following: ORDER:
" Though time was granted by this Court from 27-07-2012 for a counter affidavit to be filed, no counter affidavit has been filed till date. Learned Government Pleader for Home seeks one more week's time to file counter affidavit.
Post on 22-11-2012. In case no counter affidavit is filed by the next date of hearing, the third respondent (Commissioner of Police,
Hyderabad) shall be personally present in the Court on 22-11-2012 at 10.30 A.M.
Learned Government Pleader for Home is present in the Court, and undertakes to inform the third respondent of his obligation under this order."
