THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17726 OF 2019 ORDER :
This writ petition is filed challenging inaction of the respondents 2 and 3, Superintendent of Police and Station House Officer, Ashwaraopet, respectively, in registering the complaint submitted on 12.07.2019 for registration of crime against the respondents 4 to 6.
Learned Assistant Government Pleader for Home produced a copy of the written instructions dt.19.08.2019 of the Sub Inspector of Police, Ashwaraopet Police Station, Bhadradri Kothagudem District. To the extent of their relevance to the present writ petition, the said instructions read as under:
"It is submitted that on receipt of above complaint, GD entry was made and preliminary enquiry was done, during enquiry it was disclosed that the contents of the complaint are civil in nature and there is a civil dispute between him and other party.
It is submitted that a Notice was sent to the petitioner through registered post on 19.8.2019 informing that the complaint given by him is closed and civil in nature and advised him to approach him civil court for redressal".
Recording the aforesaid submission of the learned Assistant Government Pleader for Home, this writ petition is disposed of granting liberty to the petitioners to avail alternative remedy as available to them under law. There shall be no order as to costs.
As a sequel, miscellaneous applications, if any pending, shall stand closed.
