HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.7156 of 2024 ORDER :

Petitioners/A-1 and A-4 have filed this petition seeking bail in Cr.No.628 of 2024 of P.S. Hayathnagar, registered for the offences under Sections 364-A, 342, 385, 323 and 506 r/w.34 of IPC. 2.

Heard learned counsel for petitioners and the learned Additional Public Prosecutor appearing for the State. 3.

The allegation against the petitioners is that they kidnapped the complainant's husband.

The grounds for seeking bail are that a false case has been registered against the petitioners and that the complainant and her husband are indebted to A-1 and to avoid repayment of such amount, a false case of kidnap has been foisted against them. It is further contended that A-1 himself invested some amounts in the Company of the complainant and her husband and that there is no necessity for them to kidnap the husband of complainant as alleged. It is contended that the petitioners are law-abiding citizens and are ready to co-operate with the Police in investigating the case and that they will comply with the conditions that may be imposed by this Court in the event of their release.

The learned Additional Public Prosecutor opposed the application contending that in view of the allegation of kidnapping, and charge sheet is yet to be filed, the petitioners cannot be granted bail.

Having heard both sides and perused the material on record, since five witnesses have already been examined, this Court is of the considered view that it is a fit case for grant of bail. 7.

Accordingly, this petition is allowed and the petitioners shall be released on bail on each of them executing a personal bond for Rs.20,000/- with two sureties for the like sum each to the satisfaction of the XIV Additional Metropolitan Magistrate, Hayathnagar. ____________________ JUVVADI SRIDEVI, J Date: 08.07.2024 rev
