THE HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

Challenging the order dated 03.02.2018 of imposing punishment of de-activating Mee-Seva services for fifteen days and penalty of Rs.2,000/-, this writ petition is filed. Apart from raising other contentions, primarily it is urged that order is not sustainable on the ground that no notice was issued and there was no opportunity before holding the petitioner guilty and imposing punishment.

Having regard to the fact that the order impugned is without notice and opportunity and order has got civil and evil consequences, learned Government Pleader fairly submits that the respondents would give due opportunity and to pass fresh orders.

Having regard to the said submission, this writ petition is allowed and the impugned order is set aside. However, it is open to the Joint Collector and Additional Director, ESD (Mee-Seva), YSR Kadapa District, to take appropriate action according to law, by issuing notice to the petitioner and affording due opportunity to the petitioner.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
