ORDER:
This writ petition is filed for a mandamus to declare the inaction of the respondents in following due process of law under Section 83 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, in respect of the lands admeasuring Acs.7.16 cents in survey No.370, Acs.4.22 cents in survey No.371/1 and Acs.12.21 cents in survey No.371/2 of Kalludevakunta Village, Mantralayam Mandal, Kurnool District, as illegal and arbitrary. At the hearing, it has come out that the petitioner has participated in the auction pertaining to the lands admeasuring Acs.7.16 cents in survey No.370 and Acs.4.22 cents in survey No.371/1 and having emerged as the successful bidder, he has paid the lease amounts. As regards the land admeasuring Acs.12.21 cents in survey No.371/2, the learned counsel for the petitioner, on instructions, submitted that the said land is barren land and that his client is not interested in retaining its possession and that he will handover physical possession of the same to respondent No.5 as and when its manager approaches him.
The above statement of the learned counsel for the petitioner is placed on record and the Writ Petition is disposed of with liberty to respondent No.5 to initiate appropriate action in the event the petitioner does not handover physical possession as per the statement made by his counsel as recorded above. As a sequel to disposal of the writ petition, W.P.M.P.No.33158 of 2015 filed by the petitioner for interim relief shall stand disposed of as infructuous. _________________________ C.V.NAGARJUNA REDDY, J 06th November, 2015 GHN
