HON'BLE SRI JUSTICE A. SHANKAR NARAYANA A.S.MP.No.1776 OF 2017 IN/AND APPEAL SUIT No.628 OF 2014 COMMON JUDGMENT:

A.S.MP.No.1776 of 2017 is filed under Order XXIII Rule 3 C.P.C. seeking to record compromise and pass decree in terms of the Memorandum of Compromise annexed to the petition.

2. All the three appellants - defendant Nos.1 to 3 and respondent No.6, also as General Power of Attorney holder of respondent Nos.2 to 5, are present along with their respective counsel. The parties are identified by their respective counsel, namely, Sri S. Vijay Prashant, Sri B.S. Kartik and Sri Prasad ESR. The parties have also produced photostat copies of their respective "Aadhaar Cards" in proof of their identity.

3. The parties have entered into compromise incorporating certain terms and conditions in the Memorandum of Compromise filed along with A.S.MP.No.1776 of 2017.

4. The parties have affirmed the terms mentioned in the Memorandum of Compromise, which speaks that an extent of Ac.5-07 guntas of land, out of the total extent of Ac.9-14 guntas, in Survey No.91 situated at Nagireddyguda Village and Gram Panchayat, Moinabad Mandal, Ranga Reddy District, with specific boundaries therein, has been allotted to the appellants - defendant Nos.1 to 3

together and the remaining extent of Ac.4-07 guntas has been allotted to respondent Nos.2 to 6. Having satisfied with the adjustment, as per the terms incorporated in the Memorandum of Compromise, compromise is recorded.

5. Hence, A.S.MP.No.1776 of 2017 is allowed.

6. Since, compromise is recorded, as per the terms mentioned in the Memorandum of Compromise, the present appeal is disposed of. The terms of Memorandum of Compromise shall form part of the decree.

7. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J August 09, 2017.
