HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.31264 OF 2017 ORDER:

This Writ Petition is filed seeking a direction to the respondents 2 and 3 to incorporate the change of constitution of the petitioner firm and consequently, to restore the supply of material required it.

2) It is the case of the petitioner that originally respondent No.2 has granted dealership licence in favour of one Sri Gadiraju Bangara Raju, S/o Venkata Narayana Raju and sri Kovvuri Ananda Mohan Reddy S/o Satyanarayana Reddy. Both the individuals had formed a partnership firm under the name and style of M/s. G.V.N. Raju Enterprises. Subsequently, Kovvuri Ananda Mohan Reddy retired from the partnership firm and one Sri Meesala Srinivasa Rao, S/o Late Suryanarayana had joined the same. Necessary changes have been made and updated the registration of firms. While so, the petitioner had approached respondent Nos.2 and 3 informing the change of constitution of firm by furnishing necessary particulars. In spite of the same, the respondent Corporation is not acting and carrying out the necessary changes. Hence the present writ petition.

3) Heard the learned counsel for the petitioner. 4) Sri Mayur Reddy, learned counsel for the respondent Corporation submits that the petitioner had suppressed various facts and particularly, the factum of having been issued the show cause notice, dated 11.01.2017, alleging violation of dealership agreement.

no material furnished by the petitioner and the alleged information is filed only for the purpose of the Writ Petition. 5) Having considered the respective submissions and having perused the material on record, as the respondents have denied receipt of any application from the petitioner, this Writ Petition is disposed of, giving liberty to the petitioner to submit the application within one week from the date of receipt of a copy of this order and within eight weeks thereafter, the respondents shall consider and dispose of the same.

6) With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

7) As a sequel, miscellaneous petitions pending, if any, shall stand closed.
