THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.14145 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare inaction of the respondents in representations made to the respondents by the members of the petitioners' Union on 20-11-2014, 01-07-2015, 14-09-2015, 29-09-2015, 28-12-2015, 02-01-2016 and 10-03-2016 to pay the salaries to the members of the petitioners Union from 0108-2015 to 31-03-2016 and not paying wages equal work to equal pay, which is paying to the regular employees (hand pump mechanic) and also not regularizing the service in the organization of the respondents as illegal, arbitrary, unjust, unconstitutional, unlawful and against to the provisions of the Contract Labour (Abolition and Regulation) ACt, 1970 and against to Articles 12, 14, 16, 19, 21 and 23 of the Constitution of India and against to the principles of natural justice and against to the judgment of the Apex Court and set aside the same."

Heard Sri Chikkudu Prabhakar, learned counsel for the petitioner and learned Government Pleaders for Panchayat Raj and Labour for respondents.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 1003-2016 to the 2nd and 3rd respondents herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 2nd and 3rd

respondents to pass appropriate orders on the representation, dated 10-03-2016, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Government Pleaders for respondents and submitted that the said representation would be considered, in accordance with law.

For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter, directing the 2nd and 3rd respondents to consider and pass appropriate orders on the representation, dated 10-03-2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
