THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.1288 of 2005 JUDGMENT:

This appeal is filed under Section 100 CPC aggrieved by the judgment and decree dated 31.08.2005 in A.S.No.20 of 2004 on the file of the Court of VII Additional District Judge, Madanapalle, whereby where under the judgment and decree dated 28.02.2004 in O.S.No.11 of 1999 on the file of the Court of Senior Civil Judge, Punganur, decreeing the suit filed by the plaintiff for declaration, was confirmed.

At the time of hearing, learned counsel for the appellants seeks permission of this Court to permit the appellants to withdraw the second appeal and to that effect he also filed a letter dated 28.12.2017 before the Registry. Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
