WRIT PETITION No.34899 of 2012 ORDER:

This Writ Petition is filed for the following substantive relief: "For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus or any other appropriate writ, order, direction declaring the action of Respondent No.7 in demanding the Petitioners to pay each a sum of Rs.2,00,000/- towards college fee/tuition fee, otherwise they will not permit the Petitioners to attend the classes and will not permit them to sit for Internal, Annual examinations which are going to be held in the month of February 2013, which is contrary to the endorsement made in the Admission letters and also violative of principles of natural justice and also violative of Articles 14, 16, 19 & 21 of the Constitution of India, consequently directing the 7th Respondent not to demand or ask either orally or in writing the Petitioners to pay any amount towards college fee/tuition fee in their entire course of MBBS are completed."

At the hearing, Sri A.Prabhakar Rao, learned Standing Counsel for Dr. NTR University of Health Sciences submitted that subsequent to the filing of this Writ Petition, the petitioners were allowed to pursue MBBS Course and that they have completed the course of study. He has also submitted that the issue relating to the payment of fees was settled by the Government during pendency of this Writ Petition and that therefore, the cause in the Writ Petition does not survive for adjudication.

In view of the above submissions of the learned Standing Counsel, the Writ Petition is disposed of as infructuous. As a sequel to disposal of writ petition, WPMP.No.44362 of

2012 filed by the petitioners for interim relief is disposed of as infructuous.
