ORDER:
Heard the learned counsel appearing for the petitioner.

It is submitted by the learned counsel appearing for the petitioner that the scheduled property in both the suits is not one and the same and the reliefs claimed are also different and therefore, the learned District Judge erred in allowing the petition under Section 24 of C.P.C. The learned District Judge has recorded a specific finding that the dispute involved and the evidence to be adduced in both the suits is one and the same and therefore, it is just and reasonable that both the matters are heard and tried by one and the same Court to avoid multiplicity of the litigation and conflicting decisions. I do not find any error committed by the learned District Judge. 3.
