Heard learned counsel for petitioner and learned Assistant Government Pleader for Revenue.

Petitioner claims to be member of founder family of Sri Deval Balaji Venkateswara Swamy Devasthanam, Bandapalem village, Kodada mandal, Suryapet district. As per the procedure evolved, in rotation, one member of the founder family is authorized to act as joint cheque power holder along with Executive Officer. Each founder family member is given two years period in rotation to enjoy such power. On 15.11.2017 proceedings were issued by the Assistant Commissioner-4th respondent appointing petitioner to exercise the joint cheque power, thus, petitioner is entitled to continue as such till 15.11.2019. While so, on 15.5.2019 abruptly the cheque power of the petitioner was withdrawn and same was entrusted to another founder family member. Aggrieved by the said action, petitioner filed representation before the Commissioner on 25.6.

2019, wherein he has made allegations against the Executive Officer in not maintaining the accounts property and that he was forcibly removed only because he was questioning the illegal manner of functioning of the Executive Officer. Alleging inaction on the said representation, this writ petition is filed.

Copy of representation dated 25.6.2019 acknowledged by the office of the Commissioner on the same day, is filed as Ex.P-4. A copy of it is also marked to 4th respondent. In view thereof, with the consent of the learned counsel for petitioner and learned Assistant Government

Pleader, writ petition is disposed of directing the 4th respondent to examine the claim of the petitioner as ventilated in his representation dated 25.6.2019 and if he accepts the claim of petitioner, to issue notice and afford opportunity of hearing to the person who is now holding the cheque power and take appropriate decision as warranted by law within a period of three weeks from the date of receipt of copy of this order.
