This writ petition is filed challenging the proceedings dt.05.08.2019 issued by the 3rd respondent and consequential Circular dt.07.08.2019 issued by the 4th respondent to conduct elections on or before 20.08.2019 for Office Bearers of PESA Committee i.e. Vice President and Secretary, even before the term of office of the petitioners is expired.
This Court on 16.08.2019 grated interim order which reads as follows;
"In view of the facts and circumstances and the submission of the learned counsel, it is made clear that election process may go on, but however, the petitioners' term as elected representatives, shall not be disturbed, and elections can be conducted only after the term of the petitioners expires."
Learned Government Pleader for Tribal Welfare submits that petitioners are entitled to continue as Office Bearers till 29.09.2019 as per Rule 4(ii) of the Andhra Pradesh Panchayats Extension to Scheduled Areas (PESA) Rules, 2011.
Learned Counsel for the petitioners submits that writ petition can be disposed of recording the aforesaid submission of learned Government Pleader.
In view of the above, recording the submission made by learned Government Pleader for Tribal Welfare, the writ petition is disposed of directing the respondents to allow the petitioners to continue as Office Bearers i.e. Vice President and Secretary of the PESA Committee, respectively, upto 29.09.2019. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
