HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.124 of 2016 ORDER:

This petition is filed to withdraw H.M.O.P.No.72 of 2014 from the file of Senior Civil Judge, Nuzvid, Krishna District and transfer the same to Senior Civil Judge, Tanuku, West Godavari District.

2. Wife filed this petition. According to her affidavit her marriage with respondent was solemnized on 18.05.2005 at BD Varthaka Sangham in Tanuku as per Hindu rites, Ceremonies and custom and thereafter due to adamant attitude of respondent, she was necked out from marital home on 23-06-2013. She stated that respondent filed H.M.O.P.No.72 of 2014 seeking dissolution of marriage with all false and frivolous grounds and she filed counter contesting the same. She stated that she filed M.C.No.35 of 2014 before II Additional Judicial First Class Magistrate, Tanuku and respondent contested the same and the Court granted Rs.3,000/- per month as maintenance. She stated that she is finding difficult to travel from Tanuku to Nuzvid to attend for each and every adjournment, therefore she is constrained to file this petition seeking transfer of H.M.O.P.No.72 of 2014 from Nuzvid to Tanuku.

3. On 24.02.2016, this Court permitted petitioner to take out personal notice to respondent through registered post with acknowledgment due and file proof of service. In compliance of the said order, registered notice sent to respondent was served on him and the postal acknowledgment is filed along with Memo dated 09.03.2016. In spite of service of notice respondent neither appeared in person nor through any advocate.

4. Heard arguments.

Considering the reasons stated in the affidavit filed in support of the petition and also considering the convenience of wife, H.M.O.P.No.72 of 2014 is withdrawn from the file of Senior Civil Judge, Nuzvid, Krishna District and transferred to Senior Civil Judge, Tanuku, West Godavari District for disposal in accordance with law.

6. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 15-03-2016 gvl
