Heard Sri A.Rajendra Babu, learned counsel for the petitioner and the learned Government Pleader for Services-III. With the consent of learned counsel for the respective parties, this Writ Petition is disposed of at the admission stage. This writ petition is filed seeking the following relief :- ".............Writ of Mandamus declaring the action of the respondents more particularly the 1st respondent in not disposing the appeal dated 21.07.2011 and the remainders dated 14.05.2014 and 07.11.2014 of the petitioner by not considering the information submitted by the 2nd respondent dated 15.03.2012 is arbitrary, illegal and contrary to law and to issue a consequential direction to the 1st respondent to dispose of the appeal filed by the petitioner, dated 21.07.2011 and the reminders dated 14.05.2014 and 07.11.2014 forthwith and to pass such other order ..............."

It has been contended by the petitioner that petitioner's husband has been working as Kamatee with the respondents since 1990 and has expired on 08.05.2009 while discharging his duties. Thereafter, petitioner had submitted an application to the 2nd respondent seeking compassionate appointment but the same was rejected vide order dated 16/18.07.2011. Against the same, petitioner preferred an appeal on 21.07.2011 before the 1st respondent. Subsequently, the 1st respondent issued memo dated 02.08.2011 and in pursuance of the said Memo the 2nd respondent vide letter dated 15.03.2012 recommended the case of the petitioner. But the 1st respondent did not pass

orders either on the appeal preferred by the petitioner or the reminders dated 14.05.2014 and 07.11.2014.

Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the 1st respondent to dispose of the appeal preferred by the petitioner on 21.07.2011 by duly taking into account the recommendations submitted by the 2nd respondent on 15.03.2012.

Learned Government Pleader appearing for the respondents contends that the 1st respondent would consider the appeal preferred by the petitioner and appropriate orders would be passed in accordance with law.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the 1st respondent to dispose of the appeal preferred by the petitioner on 21.07.2011 by duly taking into account the recommendations submitted by the 2nd respondent on 15.03.2012 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
