The petitioner filed this writ petition seeking to declare that the 4th respondent has no right to continue as Deputy Chief Engineer after attaining the age of 58 years. 2.
When this matter is taken up for hearing, it is noticed that this writ petition is dismissed for default against the 4th respondent vide order dated 18.8.2010. The petitioner has not taken any steps to get the writ petition restored against the 4th respondent. In the absence of the 4th respondent, this writ petition cannot be adjudicated on merits.

Accordingly, the Writ Petition is dismissed. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand closed.
