THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.27260 of 2009 ORDER :

This writ petition is filed challenging the rejection of the petition filed by the petitioner for Freedom Fighters Pension on the ground that the age mentioned by the petitioner in the voters' list is lesser than the age required as per the rules framed by the authorities. The petitioner challenged the said act on the ground that the age mentioned in the voters' list alone cannot be considered and the authorities should consider the report of the Medical Board also. The learned counsel for the petitioner submitted that during the pendency of the Writ Petition, the Central Government has issued an order directing the authorities that while considering the petitions of the Freedom Fighters, determine the age not only on the ground of the age mentioned in the voters' list, but also as per the report of the Medical Board.

Hence, this Court is of the view that as the Central Government has taken a view to consider the petitions of the Freedom Fighters to determine the age not only on the ground of the age mentioned in the voters' list, but also as per the report of the Medical Board, the respondents herein are directed to consider the age of the petitioner also on the basis of the report of the Medical Board and pass appropriate orders within a period of three months from the date of receipt of a copy of the order.

Accordingly, the Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition are closed.
