ORDER

When the matter is taken up for hearing, learned counsel appearing for the petitioner contended that the relief sought for by the petitioner seeking declaration of his probation was granted by the respondents on 4.10.2019. It is contended that the competent Criminal Court has dropped further prosecution against the petitioner in Cr.No.16 of 2012. It is further contended that in view of the subsequent development, the only issue that remains to be considered in this writ petition is as to granting of consequential benefits, increments, and promotion to the petitioner. In view of pendency of criminal case, the case of the petitioner for declaration of his probation and also for promotion was not considered. It is prayed that the respondents be directed to release the consequential benefits and consider the case of the petitioner for promotion on par with his juniors. Learned Government Pleader appearing for the respondents contended that if the petitioner submits a representation afresh, the respondents would consider the same and pass appropriate orders.

Having considered the rival submissions made by the learned counsel on either side, this Writ Petition can be disposed of directing the petitioner to submit a representation afresh staking his claim for promotion to the post of Section Officer on par with his juniors and also for release of increments during the suspension period within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents shall consider the same and pass appropriate orders within a period of eight weeks thereafter.

Accordingly, the Writ Petition is disposed of . No costs. Pending miscellaneous petitions, if any, shall stand closed.
