THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.35144 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner filed an application dated 11.09.2015 seeking 'No Objection Certificate' from the District Collector, Chittoor District, the 2nd respondent, in terms of G.O.Ms.No.307, Revenue (Assignment.I) Department, dated 06.06.2013. Complaining inaction on the part of the 2nd respondent, the present Writ Petition is filed. Keeping in view the date of application itself being 11.09.2015, I do not see any ground for inaction is made out, as the 2nd respondent has to call for remarks from his subordinate officers and then consider the request of the petitioner and this exercise necessarily involves some time.

Hence, though the Court is not satisfied with the allegation of the petitioner, in the interests of justice, it is appropriate to direct the 2nd respondent to examine the application of the petitioner in the light of the reports from his subordinate officers and take appropriate decision in the matter preferably within a period of two months from the date of receipt of a copy of this order.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
