- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.3939 OF 2011 ORDER:

This writ petition is filed challenging the order dated 10.12.2010 issued to recover the amount as a consequence to revision of financial up gradation.

A reading of the prayer would show that petitioner is not challenging the order dated 27.09.2010 by which the financial up gradation earlier granted was altered. However, this Court granted stay of recovery by order dated 28.02.2011.

On 16.11.2017 when the matter was heard, learned Standing counsel produced proceedings dated 09.11.2017 stating that petitioner was granted financial up gradation as per the Modified Assured Career Progression Scheme, with effect from 01.09.2008 i.e., from the date of introduction of the scheme and his pay was re-fixed and difference of amount towards arrears was also paid vide bill dated 18.03.2014.

Since the petitioner was granted the financial up gradation as per the Modified Assured Career Progression Scheme and arrears amount was also paid, the cause in the writ petition does not survive.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
