Heard.

The petitioners question the notice, dated 03-07-2015, issued by the 4th respondent under Section 7 of the A.P.Land Encroachment Act, 1905. The petitioners state that have already filed explanation on 22-07-2015 and no orders are passed so far. However, without passing appropriate orders on the said explanation, the 4th respondent is trying to dispossess them. Hence, the present writ petition is filed. I do not see any ground questioning the jurisdiction of the 4th respondent in issuing the said notice. Even according to the petitioners, part of their land was regularized earlier and to the extent of remaining land, they have filed further application on 27-09-2004 seeking regularisation. The petitioners state that no orders are passed so far.

Since the 4th respondent is already stated to have received explanation of the petitioners, it is appropriate for the 4th respondent to consider the same and pass appropriate orders in accordance with law. Till passing of such order, the petitioners shall not be dispossessed in pursuance of the impugned notice. Accordingly, the writ petition is disposed of. No costs.
