THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8935 of 2016 ORDER:

This Criminal Petition is filed by the petitioner/A-1 under Sections 437 and 439 of the Code of Criminal Procedure, 1973 seeking to grant bail in Crime No.96 of 2016 of Old Giddalur Police Station, Prakasam District, registered for the offence punishable under Section 20(b)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Heard and perused the material available on record.

3. Case of the prosecution is that on 25.4.2016, the petitioner herein was found transporting 50 kgs. of ganja illegally.

4. Learned counsel for the petitioner submitted that the petitioner is innocent of the offence alleged against him and he has been falsely implicated in the present case.

5. The petitioner was arrested on 26.4.2016. The petitioner was found in possession of 50 kgs. of ganja. Since the ganja found is more than the commercial quantity and considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.
