THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15318 of 2003 ORDER:

This writ petition is seeking the following relief: " to issue an order or direction or writ more in the nture of writ of Mandamus declaring the action of the respndents in not extending the benefit of G.O.Ms.No.87 Finance and Planning (F.W.

PEN-I) Department dated 25.5.1998 to the members of petitioners society who have retired before 25.5.1998 as illegal and null, void and violative of Article 14 of constitution of India and consequently declare all such members of petitioner society as entitled to the benefit under G.O.Ms.No.87 (F.W.

PEN.I) Department, dt.25.5.1998 with all arrears from 25.5.1998 and direct the 3rd respondent to re-fix the pension of all such above members, and pay the same forthwith and to pass such other or further orders as this Hon'ble Court may deem fit and proper."

When the matter is taken up for hearing, learned Standing Counsel appearing for the 3rd respondent had submitted that consequent upon dismissal of Special Leave Petition preferred by the State, the Government, in principle, has decided to extent the benefit of orders in respect of G.O.Ms.No.87 dated 25.5.1998 to all its employees and the 3rd respondent University had also adopted the said G.O. and is extending the benefit to members of the petitioner association. Learned counsel for the petitioner association submits that the writ petition can be disposed of directing the respondents to extend the

benefit of G.O.Ms.No.87 dated 25.5.1998 to the members of the petitioner association.

This Court having considered the submissions made by the parties is of the considered view that this Writ Petition can be disposed of directing the 3rd respondent to extend the benefit of G.O.Ms.No.87 dated 25.5.1998 to the members of the petitioner association. Accordingly, the Writ Petition is disposed of directing the 3rd respondent to extend the benefit of G.O.Ms.No.87 dated 25.5.1998 to the members of the petitioner association. No order as to costs.
