THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34797 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a direction to the 4th respondent not to interfere with the personal liberty of the petitioners herein.

The main grievance of the petitioners is that the 4th respondent, who is the Deputy Superintendent of Police, C.I.D. Department, Visakhapatnam in collusion with the 6th respondent, calling the petitioners to his office without there being any complaint and that they were abused and detained by him to settle the property dispute with the 6th respondent herein. However, to substantiate the said allegations, the petitioners have not lodged any complaint against the 4th respondent about his highhanded action.

Considering the grievance of the petitioners, the petitioners are directed to lodge a complaint before the superior officer of the 4th respondent and on such representation/complaint, the officer concerned is directed to dispose of the said representation/complaint after conducting due enquiry in accordance with law. The 4th respondent is also directed not to interfere with the affairs of the petitioners more particularly, between the affairs of petitioners and 6th respondent without there being any specific complaint, which discloses a cognizable offence against the petitioners.

Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 17.10.2016.
