THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 165 OF 2015 O R D E R:

This Company Petition is filed for winding up of the respondent Company for non-payment of the debt due to the petitioner.

Learned counsel for the petitioner submits that the respondent Company is pursuing the proceedings before the National Company Law Tribunal and the Resolution Professional has already been appointed. He further submits that the petitioner has also made a claim for adjudication before the Resolution Professional. In those circumstances, nothing survives for adjudication in the Company Petition.

Accordingly, the Company Petition is closed, leaving it open to the petitioner to work out the remedies available to it before the National Company Law Tribunal.
