THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4385 of 2015 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. to quash the

proceedings in Cr.No.63 of 2015235 of 2014 of Cherial Police Station, Warangal District.

Heard the learned counsel appearing for the petitioner/accused and the learned Additional Public Prosecutor, representing the State. Basing on the complaint lodged by the 2nd respondent/complainant the police registered a case against the petitioner/accused for the offences punishable under Sections 447 and 323 I.P.C., and under Sec.3(1)(x) of the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act, 1989. The material on record reveals that there are civil cases pending in between the petitioner and the de facto complainant. The allegations in the complaint, prima facie, reveal the commission of alleged offences by the petitioner. This is a matter, which requires investigation by the police, and there are no valid grounds to quash the First Information Report.

In view of the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioner in Cr.No.63 of 2015 of Cherial Police Station, Warangal District. Pending miscellaneous applications, if any, shall stand closed in consequence.
