wp_6916_2016 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) The son of the petitioner was detained under the provisions of the Telangana Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act, 1986, on the allegation that he is a habitual offender indulging in the theft of laptops and mobile phones from the students' hostels located in various parts of the city of Hyderabad.

Sri Venkat Reddy Kodumury, learned counsel for the petitioner, submitted that the detenu is an young man having completed his engineering course and he has served detention for ten months. He has pleaded for taking a lenient view by undertaking that his client will stay away from Hyderabad city till the balance of the detention period expires.

Considering the fact that the detenu has served detention for ten months, his age and the qualification, we are of the opinion that interests of justice would be served if he is released from detention, if he is not required in any other case (s), subject to his executing a bond in favour of respondent No. 2 and handover to respondent No. 4 at the time of his release that immediately on his release from detention, he will leave and not re-enter Hyderabad till the balance period of detention is over and that the detenu shall stay with his father at Mettameedipally Village, Markapur Mandal, Prakasam District, for the aforementioned period and report to the jurisdictional police station once in three days till the balance detention period is over.

Subject to the above conditions, the detention orders are quashed and the Writ Petition is, accordingly, allowed.
