THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.213 of 2016 ORDER:
This application is filed to withdraw O.P.No.30 of 2015 from the Court of Senior Civil Judge, Bodhan, and transfer the same to Court of Senior Civil Judge, Armoor.
2. Wife filed this application. According to her affidavit, her marriage with respondent was solemnized on 06.12.2007 and respondent started harassing her for additional dowry and that she was deserted. She stated that she filed M.C.No.10 of 2015 and also Domestic Violence Case before Judicial First Class Magistrate, Armoor, and that respondent filed O.P.No.30 of 2015 before Senior Civil Judge, Bodhan, for dissolution of marriage. She further stated that it is difficult for her to travel from Armoor to Bodhan as she is financially not sound to meet the travel expenses. She stated that no prejudice will be caused to respondent if the O.P. is transferred, as he is gainfully employed. For these reasons, she prayed for transfer of O.P.No.30 of 2015 from the Court of Senior Civil Judge, Bodhan, to Court of Senior Civil Judge, Armoor.
2. Notice sent to respondent returned un-served with endorsement 'refused'.
3. Advocate for petitioner submitted that respondent is attending the Court at Armoor for Maintenance Case and Domestic Violence Case and if this case is also transferred to Armoor, it would be convenience to both parties, as all the cases will be at one place.
4. Considering the reasons stated in the affidavit filed in support of this petition and also considering the convenience of wife, O.P.No.30 of 2015 is withdrawn from the Court of Senior Civil Judge, Bodhan,
and transferred to Court of Senior Civil Judge, Armoor, for disposal in accordance with law.
5. The petition is ordered accordingly. No costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed. ___________________ S. RAVI KUMAR, J 22nd August, 2016.
