THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.18052 of 2009 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the orders of the 3rd respondent [NABARD] issued in ref No.NB/APRO/CPD/5118/A10/2008-09, dated 13-06-2008, and the consequential proceedings of the 4th Respondent [APCOB] in Ref No.UB/ADV/SECTT/F.

290 Dated 14-06-2008, denying the benefit of Debt Relief Scheme 2008, to the members of the petitioner society as illegal, unjust, arbitrary, discriminatory in violation of Art 14 and 21 of Constitution of India and contrary to the policy of the 1st respondent and the guidelines issued there of and consequentially set-aside the same with a further direction to the respondents particularly respondents 3 to 6 to grant benefit Under Agri Debt Waiver and Debt Relief Scheme 2008 to the members of the petitioners society who obtained Agricultural Loans from the petitioner society and pass such other order or orders as are deem fit and proper in the circumstances of the case."

I have heard the submissions of Sri V.Sai Kumar, learned counsel appearing for the petitioner society, of Sri K.Lakshman, learned Assistant Solicitor General, appearing for the 1st respondent, of learned Government Pleader for Co-operation appearing for the 2nd respondent; and, of Sri S.Srinivas Reddy, learned Standing Counsel appearing for the 5th respondent. There is no representation for the respondents 3 & 4. I have perused the material record.

At the hearing, a joint representation was made that the subject matter and the issue involved in this writ petition are

MSRM, J W.P.No.18052 of 2009 squarely covered by the common order of this Court, dated 15.12.2015, in W.P.No.24536 of 2012 & batch. A copy of the said common order is placed on record.

Having regard to the submissions and for the reasons alike, as were mentioned in the afore-stated common order, dated 15.12.2015, in W.P.No.24536 of 2012 & batch, this Writ Petition is also disposed of in terms of the said common order. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
