HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.46458 of 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking to declare the proceedings of the District Collector, Medchal-Malkajgiri District, in file No.E5/1070/2016 dated 16.04.2016 as illegal and arbitrary. Heard the learned counsel for the petitioners and learned Assistant Government Pleader for Revenue. With their consent, the Writ Petition is disposed of at the admission stage itself. During the course of arguments, it is brought to the notice of this Court that against the order of the District Revenue Officer, one of the petitioners preferred CCLA vide No.BCW5/314/2004 and the same is still pending consideration.
At this juncture, learned counsel for the petitioners restricts his prayer seeking a direction to the authorities concerned for disposal of the appeal within a prescribed period. Learned AGP would submit that he has no objection for the same.
Having regard to the fact that the appeal filed against the order of the DRO is pending consideration since more than 12 years and pendency of the same was made the basis for passing the impugned proceedings, the Writ Petition is disposed of directing the 2nd respondent to dispose of the appeal bearing No.BCW5/314/2004 in accordance with law as early as possible,
preferably within a period of 6-8 weeks from the date of receipt of a copy of this order.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
