HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION NO. 2149 OF 2015 ORDER:

At the admission stage, the following order is passed. It is stated that A1 is the son of A2 and A3. Charge sheet is filed by the police of Nandigama Police Station, Krishna District, against petitioners for the offences under Section 304-B IPC and Section 4 of Dowry Prohibition Act. As per the submission of learned Additional Public Prosecutor, the matter was committed to Sessions Court and case was registered as S.C.No. 233 of 2014 and the same is now pending in the Court of Additional Sessions Judge, Nandigama.

Having regard to the stage of the matter, it is not a fit case to quash the proceedings. However, petitioners/A2 & A3, if advised, can file a discharge application putting forth all the defenses legally available to them, in which case, the trail court shall dispose of the said application on merits expeditiously.

Accordingly, this Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
