HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO: 4 0 1 1 OF 2015 O R D E R :

This writ petition is filed to declare the action of the second respondent in interfering into the civil disputes without jurisdiction, arbitrary, violation of Article 14 and 21 of the Constitution of India and consequently to direct the respondent No.2 not to interfere in civil dispute between the petitioner and respondent No.3 in respect of Plot bearing No.38 in survey No. 160, ward No.12, Block No.13, admeasuring 300 sq.yards situated at Nagarjuna Nagar colony, Lalaguda, Tarnaka, Secunderabad and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home [Telangana].

3. The present writ petition has been filed alleging that the second respondent is interfering with the peaceful possession and enjoyment of the petitioner. It appears that there is a dispute between the petitioner and third respondent in respect of erecting gate and the cause of action arose on 09/2/2014 and the said allegation is denied. According to the written instructions dated 26/2/2015, Sri Ram Mohan Rao, Assistant Government Pleader for Home represents before this Court that a case has been registered

against the petitioner and the investigation is completed and charge sheet is filed, vide C.C.No.854 of 2013 on the file of the Court of IV-Additional Chief Metropolitan Magistrate at Nampally, Hyderabad.

4. In view of the above submission made by the Assistant Government Pleader for Home, the writ petition is devoid of merits and the same is dismissed. No costs.

5. As a sequel, miscellaneous petitions, if any pending in this writ petition shall stand closed.
