THE HON'BLE MS.JUSTICE J.UMA DEVI CIVIL REVISION PETITION NO.2825 OF 2018 ORDER:

This Civil Revision Petition is filed by the petitioner/plaintiff (D.Hr) under Article 227 of the Constitution of India seeking a direction to the Senior Civil Judge, Siddipet, to dispose of E.A.No.59 of 2014 in E.P.No.12 of 2011 in O.S.No.10 of 2002 at the earliest without causing any further delay.

Learned counsel for the petitioner is present. He states that he sent notices to the 1st respondent and to the counsel of other contesting respondents viz., the respondent Nos.9 to 31 through courier and filed report regarding service of notices on 1st respondent, who is an Advocate/party in person and on the counsel for respondents Nos. 9 to 31. The said report shows that the counsel for respondent Nos. 9 to 31 is served with notices. According to the memo filed by the learned counsel for the petitioner vide USR No.40555/2018 even the respondent No.1 was served with the notice sent to him through courier. Despite the service of notice on respondent No.1 and on the counsel for respondent Nos.9 to 31, none appeared before this Court. Respondent Nos. 2 to 8 are arrayed as not necessary parties.

It is understood after hearing to the submissions made by the counsel for the petitoner that E.A.No.59 of 2014

filed by the revision petitioner is pending on the file of Senior Civil Judge, Siddipet, from 2014 onwards. As the said E.A. is kept pending from 2014 onwards, the petitioner has filed the present revision petition seeking a direction to the Senior Civil Judge, Siddipet, for disposal of it at the earliest. 4.

Having regard to the fact that E.A. is pending from 2014 onwards, it is felt that it is appropriate to direct the lower Court to dispose of the said E.A. at the earliest without causing any delay.

The Civil Revision Petition is disposed of accordingly by giving a direction to the Senior Civil Judge, Siddipet, to dispose of E.A.No.59 of 2014 in E.P.12 of 2011 in O.S.No.10 of 2002 as expeditiously as possible, preferably within a period of 3 months from the date of receipt of a copy of this order. But there shall be no order as to costs. Miscellaneous petitions, if any pending in this revision shall stand closed. _________________ J.UMA DEVI, J DATED: 20-07-2018.
