THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.41278 of 2014 ORDER:

The petitioner claims to be owner and possessor of agricultural land admeasuring Acs.2.60 cents situated in survey No.451 of Gundlapalli Village, Maddipadu Mandal, Prakasam District. It is the case of the petitioner that he had constructed Asbestos Sheet Shed and maintaining cattle there. In the year 1993, the land was proposed to be acquired and a notification under Section 4(1) of the Land Acquisition Act (for short 'the Act') was issued on 05.06.1993, in which, the name of the petitioner was shown as 'owner/occupier', with respect to survey No.451. To that effect, a copy of the notice published under Section 5A of the Act, has been filed. It is alleged that as on date, there exists a paddy crop and the Tahsildar, Maddipadu Mandal, the 3rd respondent, is not permitting the petitioner to harvest it.

Though the land was acquired in 1993, for the purpose of setting up of APIDC, the petitioner continued to be in possession of the said land, as the same was not utilized for the purpose for which it was acquired. The grievance of the petitioner is that the 3rd respondent herein is threatening to dispossess him now. Hence, this writ petition. Learned Assistant Government Pleader for Revenue, on instructions received from the 3rd respondent, submits that the respondents are in no manner interfering with the peaceful possession and enjoyment of the petitioner over the subject-land. However, it is only the mining officials, who had approached the petitioner and not the revenue authorities. Hence, the petitioner has no grievance as of now.

Recording the submission of the learned Government Pleader that the respondents are not interfering with the petitioner's possession over the subject-land, the writ petition is closed. There

shall be no order as to costs.

The miscellaneous petitions filed in this writ petition shall also stand disposed of.
