Heard the learned counsel for the petitioner and the learned Government Pleader for Home appearing for respondent Nos.1 to 4.
2. Petitioner alleges that at the instance of 5th respondent, respondent Nos.3 and 4 are interfering with the possession and enjoyment of the petitioner's property. 3.
It is a matter of record that the 5th respondent obtained an order of temporary injunction against 3rd respondent in respect of certain land. However, learned counsel for the petitioner alleges that it is the petitioner who is in possession of the land which is subject matter of that suit.
4. Be that as it may since the petitioner has an appropriate remedy before the competent Civil Court in the form of an injunction to restrain the 5th respondent from interfering with his land in possession and enjoyment of the property, granting liberty to the petitioner to avail the said remedy, this ;Writ Petition is dismissed. No costs. 5.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
