THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 5436 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'Cr.P.C.') to quash the proceedings in C.C.No. 273 of 2008 on the file of the Court of learned Judicial Magistrate of I Class at Godavarikhanai (for short, 'the Court below') registered for the offences punishable under Sections 403, 406, 477 and 420 of IPC.

The petitioner is Ex Managing Director of Sri Dhatri Mutually Aided Cooperative Credit Society Limited, Goidavarikhani (for short, 'the Society'). In the proceedings under the Co-operative Societies Act, liability of Rs.71,00,000/- was fixed against the petitioner and accordingly he paid the amount. 3.

Now, the petitioner is seeking quashment of the proceedings on the ground that he paid the amount to the Society. Payment of the amount is directly admitting the liability. Therefore, at this stage, the proceedings cannot be quashed. However, the Court below is directed to dispose of C.C.No. 273 of 2008 pending on its file as expeditiously as possible and in any event not later than three months from the date of receipt of a copy of this order since the calendar case is of the year 2008.

With the above direction, the criminal petition is dismissed. Pending miscellaneous petitions, if any, in this criminal petition shall stand dismissed in consequence.
